Terms of Service

1. Acceptance

By creating an account or using StayOnTrack, you agree to these Terms. If you don't agree, don't use the service.

2. What does StayOnTrack do?

StayOnTrack is a functional system to define habits with their associated habits; in doing so helping you build habits the sustainable way.

3. User Data Governance

Users have complete control over their data, reserving the right to modify and delete all data that they have provided, adhering to PIPEDA regulations.

4. Data Security

Users passwords (if supplied) are encrypted with BCrypt Hashing algorithm, and the server enforces HTTPS on all communications.

5. Plans and Billing

StayOnTrack offers a free plan and a paid plan:

Free. No charge, no card required. Includes the Habit creation, Microhabit creation, and Basic Analytics.
Premium. $16 CAD per month. Renews automatically for the chosen term until cancelled.
Free trial. New customers may start a 7-day free trial of Premium. No payment is required, and you will be stripped of the premium features when those 7 days are over.
Pro. $24 CAD per month. Renews automatically for the chosen term until cancelled.

Payment is processed by Stripe. Pricing may change for new subscribers; existing subscribers will be given at least 30 days' notice of any price change before it affects their plan. Subscribers on earlier plans keep their original pricing for as long as they remain continuously subscribed.

6. Age & Eligibility

Users must be at least 16 years old to use StayOnTrack. You are to sign in with your Google account, and you are responsible for keeping that account secure. We do not collect information aside from Name, Email, and Profile Picture.

7. Your Content

You own and are responsible for any content you write create and save within the application. You grant StayOnTrack a non-exclusive, royalty-free license to store, process, and display that content solely to provide the service to you. This license expires when you decide to delete your account.

8. Server Uptime

We cannot guarantee uninterrupted access to data, our cloud hosting vendor, Render, has limits on how long it can run without activity.

9. Absolute Cyber Safety

Despite rigorous security measures, absolute cybersecurity cannot be guaranteed against unforeseen vulnerabilities.

10. 3rd Party Integration Reliability

StayOnTrack relies on industry-standard, cloud-based infrastructure providers to host and run our services. Our core stack includes:

Render (Application Hosting & Backend Services)
Supabase (Database & Authentication Infrastructure)
Vercel (Frontend Hosting & Deployment)

While we are committed to maintaining maximum uptime and keeping StayOnTrack accessible, our system's availability is fundamentally dependent on the operational status, service limits, and uptime guarantees of these third-party providers.

Please Note:In the event of a service disruption or outage originating from Render, Supabase, or Vercel, our team will work diligently to mitigate the impact, but absolute availability cannot be guaranteed beyond the limits of our underlying infrastructure.

11. No Guarantee of Success

StayOnTrack is a tool meant to make forming habits easier. Success is not something guaranteed; rather a shared responsibility between You, the user, & the StayOnTrack, the app.

12. Limitation of Liability

To the maximum extent permitted by law, StayOnTrack's total liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages, lost profits, or lost opportunities.
